Agreement to Terms

Welcome to Barq Media LLC ("Barq Media," "we," "our," or "us"). By accessing or using any of our mobile applications (Zikrah, Imposter Hunt, BijliWatch, Dasterkhwan, or any other apps we publish), you agree to be bound by these Terms of Service ("Terms").

If you don't agree with these Terms, please don't use our apps. We reserve the right to update these Terms at any time, and your continued use of our apps means you accept any changes.

Who Can Use Our Apps

You must be at least 13 years old to use our apps. If you're under 18, you should have permission from a parent or guardian.

By using our apps, you confirm that:

• You meet the age requirements
• You can legally agree to these Terms
• You're not prohibited from using our services under applicable law

Your Account

Some of our apps require you to create an account. When you create an account:

• You're responsible for maintaining the security of your account credentials
• You're responsible for all activities that occur under your account
• You must provide accurate and complete information
• You must notify us immediately of any unauthorized access
• You may not share your account with others or create multiple accounts to abuse our services

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal activities.

Acceptable Use

You agree to use our apps responsibly and legally. You must NOT:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Harass, abuse, threaten, or harm other users
• Post or share offensive, hateful, or inappropriate content
• Spam, scam, or attempt to defraud other users
• Attempt to hack, reverse engineer, or compromise our apps
• Use bots, scripts, or automated tools to access our services
• Collect or harvest other users' information without permission
• Impersonate others or misrepresent your affiliation
• Interfere with the proper functioning of our apps

Violations may result in immediate suspension or termination of your account.

User-Generated Content

Your Content

Some of our apps allow you to create, post, or share content (text, images, reviews, etc.). You retain ownership of your content, but by posting it, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within our apps.

Content Guidelines

All user content must comply with our acceptable use policy. We reserve the right to remove content that violates these Terms or our community standards.

Your Responsibility

You're solely responsible for the content you post. You confirm that:

• You own the content or have the right to post it
• Your content doesn't violate any laws or third-party rights
• Your content is accurate (especially important for apps like BijliWatch and Dasterkhwan)

Intellectual Property

Our apps, including all content, features, and functionality, are owned by Barq Media and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our app code or design
• Use our trademarks or branding without permission
• Create derivative works based on our apps
• Remove or alter any copyright notices

App-Specific Terms

Zikrah

• The Quran text and translations are provided for personal, non-commercial use
• Prayer time calculations are estimates; verify important prayer times with local authorities
• We're not responsible for the accuracy of any Islamic content—please consult qualified scholars for religious guidance

Imposter Hunt

• Game outcomes are for entertainment only and have no real-world value
• Maintain respectful communication in-game; harassment will not be tolerated
• We reserve the right to moderate and ban players who violate community guidelines
• Any in-app purchases are final and non-refundable except as required by law

BijliWatch

• Outage information is crowdsourced and may not always be accurate
• We're not affiliated with utility companies and can't guarantee data accuracy
• Use the app for informational purposes only—don't rely solely on it for critical decisions
• Report outage information accurately; false reports may result in account suspension

Dasterkhwan

• We connect food providers with consumers but are not responsible for food quality, safety, or delivery
• All transactions are between you and the food provider; we facilitate the connection only
• You must comply with local health, safety, and business regulations if providing food
• Report accurate allergen information; failure to do so may result in account termination
• Payment processing is handled by third-party services; fees and charges will be clearly disclosed
• Users are responsible for checking food for allergens and quality before consumption
• We reserve the right to remove users who consistently receive poor reviews or violate food safety standards

Payments and Refunds

Some apps may offer in-app purchases, subscriptions, or transaction services:

• All prices are clearly displayed before purchase
• Payments are processed through the app store (Apple App Store, Google Play) or third-party payment processors
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are handled according to the app store's refund policy or as required by law
• For transaction-based apps (like Dasterkhwan), fees and commission structures will be clearly communicated

Third-Party Services

Our apps may integrate with or link to third-party services (payment processors, map providers, social media platforms, etc.). We're not responsible for these third-party services, and your use of them is subject to their own terms and policies.

Disclaimers and Limitations of Liability

Service "As Is"

Our apps are provided "as is" and "as available" without warranties of any kind, either express or implied. We don't guarantee that our apps will be:

• Always available or uninterrupted
• Error-free or completely secure
• Accurate, reliable, or complete
• Free from viruses or harmful components

Limitation of Liability

To the fullest extent permitted by law, Barq Media and its officers, directors, employees, and agents will not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, use, or goodwill
• Service interruptions or technical issues
• Actions or content of other users
• Unauthorized access to your data

Our total liability for any claim related to our apps will not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

Important Notes for Specific Apps

• Dasterkhwan: We're not liable for food quality, safety, allergic reactions, illness, or delivery issues. Transactions are between users.
• BijliWatch: We're not liable for inaccurate outage information or any consequences of relying on the app's data.
• Zikrah: We're not liable for religious interpretations or the accuracy of Islamic content.

Indemnification

You agree to defend, indemnify, and hold harmless Barq Media from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of our apps
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post or share through our apps

Termination

We may suspend or terminate your access to our apps at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of other users
• Extended inactivity

You may also delete your account at any time through the app settings or by contacting us.

Upon termination:

• Your right to use the app immediately ceases
• We may delete your account data (subject to our Privacy Policy and legal obligations)
• Provisions that should reasonably survive (like disclaimers and liability limitations) will continue to apply

Changes to Our Apps

We're constantly improving our apps. We may:

• Add, modify, or remove features
• Change pricing for subscriptions or services (with advance notice)
• Discontinue apps or services entirely

We'll try to notify you of significant changes, but we're not obligated to maintain any particular feature or service.

Dispute Resolution

Informal Resolution

If you have a concern, please contact us first at support@barqmedia.com. We'll do our best to resolve issues informally.

Arbitration Agreement

If we can't resolve a dispute informally, you agree that any legal dispute will be resolved through binding arbitration rather than in court, except for small claims court matters or disputes that can be brought in small claims court.

You waive your right to participate in class action lawsuits or class-wide arbitration.

Governing Law

These Terms are governed by the laws of the jurisdiction where Barq Media is registered, without regard to conflict of law principles.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Barq Media regarding our apps.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms doesn't constitute a waiver of that right or provision.

Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.
